Throughout these Terms, “Pacific Horizon Living,” “we,” “us,” and “our” refer to Pacific Horizon Living, operating the website pacifichorizonliving.com.

By accessing our website, submitting a project inquiry, requesting a quotation, placing an order, or purchasing any product or service from us, you agree to these Terms of Service and all policies incorporated by reference.

Please read these Terms carefully before using the website or placing an order.


1. Eligibility and Acceptance

You must be at least the age of legal majority in your jurisdiction to place an order or enter into a binding agreement with us.

By using this website or purchasing from us, you represent that:

  • You are legally authorized to make the purchase;
  • You will use the products only for lawful purposes; and
  • You agree to comply with these Terms and applicable laws.

If you do not agree with these Terms, you should not use the website or purchase our products.

Pacific Horizon Living offers outdoor living products and related services, which may include:

  • Pergolas and louvered roof systems;
  • Outdoor kitchens and cabinetry;
  • Fire pits and fire tables;
  • Glass doors and enclosure systems;
  • Motorized screens and privacy panels;
  • Lighting, heaters, fans, motors, controls, and accessories;
  • Product configuration and project-planning support; and
  • Other outdoor living products described on our website or quotations.

Product availability, dimensions, materials, finishes, specifications, compatibility, and pricing may vary by model, market, and project.

We reserve the right to modify, discontinue, replace, or limit products and services without prior notice, subject to applicable law and confirmed customer orders.


3. Product Information and Images

We make reasonable efforts to present product descriptions, specifications, dimensions, finishes, and images accurately.

However:

  • Images, videos, renderings, and lifestyle scenes may be illustrative;
  • Screen displays and lighting may affect color appearance;
  • Natural and manufactured materials may show reasonable variations;
  • Product dimensions may be subject to normal manufacturing tolerances;
  • Accessories shown in photographs may not be included;
  • Product designs and components may be updated; and
  • Final products may differ slightly from website images.

Customers should rely on the final quotation, product specifications, approved drawings, and written order confirmation for project-specific details.


4. Pricing and Additional Charges

Prices are subject to change until an order is accepted and confirmed by Pacific Horizon Living.

Unless expressly stated otherwise, displayed prices may exclude:

  • Shipping and freight;
  • Installation;
  • Site measurement;
  • Foundations and concrete work;
  • Engineering;
  • Permits and inspections;
  • HOA, strata, or architectural-review fees;
  • Electrical, plumbing, and gas work;
  • Cranes, forklifts, and unloading equipment;
  • Customs duties, taxes, and brokerage fees;
  • Storage, redelivery, and limited-access fees; and
  • Optional accessories or third-party services.

All charges known at the time of checkout or quotation will be disclosed as clearly as reasonably possible. Material information and required charges should be presented before payment, rather than hidden in later terms.

Obvious pricing, typographical, technical, or calculation errors may be corrected. If an error affects a submitted order, we may contact the customer to confirm the corrected terms or cancel and refund the affected unfulfilled order.


5. Quotations

Quotations are valid only for the period stated in the quotation.

A quotation may be based on customer-provided information, including:

  • Measurements;
  • Photographs;
  • Drawings;
  • Site descriptions;
  • Product selections;
  • Delivery location; and
  • Installation conditions.

A quotation is not a final engineering assessment, building approval, or guarantee of site suitability unless expressly stated in writing.

Additional costs may apply if the actual conditions, measurements, access requirements, local regulations, or requested configuration differ from the information originally provided.


6. Orders and Acceptance

Submitting an order or payment does not necessarily mean that the order has been accepted.

An order becomes binding when Pacific Horizon Living:

  • Confirms the order in writing;
  • Accepts the applicable payment;
  • Finalizes the product configuration; and
  • Issues an order confirmation or otherwise begins fulfillment.

We may refuse or cancel an order for legitimate reasons, including:

  • Product unavailability;
  • Pricing or specification errors;
  • Suspected fraud;
  • Payment failure;
  • Delivery restrictions;
  • Legal or regulatory limitations;
  • Unsafe or unsupported configurations; or
  • Inability to fulfill the requested order.

If we cancel an unfulfilled order after receiving payment, we will refund the applicable amount, subject to any authorized and already-performed custom services.


7. Custom and Made-to-Order Products

Many Pacific Horizon Living products are customized or made to order.

Customers are responsible for reviewing and approving all relevant details, including:

  • Dimensions;
  • Orientation;
  • Mounting method;
  • Colors and finishes;
  • Louver direction;
  • Door, screen, and panel locations;
  • Electrical requirements;
  • Accessories;
  • Delivery information; and
  • Approved drawings.

Once design approval, engineering, material procurement, manufacturing, coating, cutting, or assembly begins, the order may become non-cancellable and non-returnable.

Changes requested after approval may be unavailable or may result in additional fees and delays.


8. Customer Measurements and Site Information

Unless Pacific Horizon Living has expressly agreed in writing to provide professional site measurement, the customer is responsible for the accuracy of all measurements and site information supplied to us.

Pacific Horizon Living is not responsible for issues caused by:

  • Incorrect measurements;
  • Undisclosed obstructions;
  • Inadequate clearances;
  • Unsuitable foundations;
  • Underground or concealed utilities;
  • Drainage conditions;
  • Property-line issues;
  • Building setbacks;
  • Roofline or gutter interference;
  • Inaccurate drawings; or
  • Other undisclosed site conditions.

Professional field verification is recommended before ordering custom-sized products.


9. Permits, Codes, and Approvals

The customer is responsible for determining and obtaining all approvals required for the project unless expressly included in a written agreement.

These may include:

  • Building permits;
  • Planning or zoning approval;
  • HOA or strata approval;
  • Architectural-review approval;
  • Structural engineering;
  • Electrical permits;
  • Gas permits;
  • Fire-department approval;
  • Historic-district approval; and
  • Landlord or property-owner authorization.

Product availability on our website does not mean that a product or configuration is approved for every jurisdiction.

Customers and their contractors are responsible for compliance with applicable building, electrical, plumbing, gas, fire, zoning, and safety requirements.


10. Installation

Installation is included only when expressly stated in the final quotation or order confirmation.

Where installation is not included, the customer is responsible for hiring appropriately qualified or licensed professionals.

Installation must follow:

  • Product instructions;
  • Approved drawings;
  • Applicable codes;
  • Foundation requirements;
  • Anchoring requirements;
  • Electrical and gas requirements; and
  • Manufacturer clearance and ventilation requirements.

Improper installation may affect product performance, safety, and warranty eligibility.

Pacific Horizon Living is not responsible for work performed by independent contractors who are not expressly acting as our authorized agents.


11. Electrical, Gas, Heating, and Fire Features

Electrical, gas, heating, and fire-feature products must be installed and serviced by qualified professionals where required by law.

The customer is responsible for verifying:

  • Fuel type;
  • Gas pressure;
  • Electrical voltage and frequency;
  • Circuit capacity;
  • Ventilation;
  • Combustible clearances;
  • Local certification requirements; and
  • Compatibility with the intended installation environment.

A fire pit, grill, heater, or outdoor kitchen should not be installed beneath a pergola or within an enclosure unless the applicable product instructions, clearances, ventilation requirements, and local codes permit it.


12. Production and Delivery Estimates

Production and delivery dates are estimates unless expressly guaranteed in writing.

Lead times may begin only after:

  • Payment requirements are satisfied;
  • Specifications are finalized;
  • Drawings are approved;
  • Required information is received; and
  • The order is released for production.

Delays may occur due to manufacturing, quality control, weather, material availability, carrier conditions, customs, ports, government action, labor disruptions, or other circumstances outside our reasonable control.

Any delay will be handled according to applicable law and our Shipping & Delivery Policy. Shopify also requires merchants to make fulfillment timelines and public-facing policies clear to customers.


13. Freight Delivery and Inspection

Large products may be delivered by freight carrier, and standard delivery may be curbside only.

The customer is responsible for:

  • Confirming delivery access;
  • Attending scheduled delivery;
  • Providing unloading labor or equipment;
  • Inspecting the shipment before signing;
  • Recording visible damage on the delivery receipt; and
  • Reporting damage or missing items within the time stated in our Shipping & Delivery Policy.

Customers should not schedule installation or third-party labor until the complete shipment has arrived and has been inspected.


14. Risk of Loss

Risk of loss and responsibility for the shipment will be determined according to:

  • The order confirmation;
  • Agreed shipping terms;
  • Carrier documentation;
  • Applicable law; and
  • The circumstances of the delivery.

Nothing in this section limits consumer rights that cannot legally be excluded.


15. Returns, Cancellations, and Refunds

Returns, cancellations, and refunds are governed by our Return, Cancellation & Refund Policy, which forms part of these Terms.

Custom, made-to-order, installed, modified, or project-specific products may not be eligible for return or cancellation except where required by law.

Customers should review the return policy before ordering. Shopify supports separate written return and cancellation rules for fulfilled and unfulfilled orders.


16. Warranty

Eligible products are covered according to our Limited Product Warranty and any applicable manufacturer warranty.

Warranty coverage may vary by product, component, and manufacturer.

The warranty does not generally cover damage caused by:

  • Improper installation;
  • Unsuitable foundations;
  • Misuse or neglect;
  • Unauthorized modification;
  • Lack of maintenance;
  • Extreme weather;
  • Incorrect electrical or gas connections;
  • Site movement;
  • Normal cosmetic aging; or
  • Failure to follow instructions.

Nothing in these Terms excludes any statutory warranty or consumer guarantee that cannot lawfully be excluded.


17. Weather and Performance Ratings

Published wind, snow, water, and load information applies only to the specific tested or engineered configuration and stated installation conditions.

Actual performance may depend on:

  • Product dimensions;
  • Configuration;
  • Enclosures and accessories;
  • Foundation;
  • Anchoring;
  • Installation quality;
  • Terrain;
  • Surrounding structures;
  • Exposure category;
  • Local weather; and
  • Maintenance.

A published rating does not guarantee that a product will remain undamaged during every storm or weather event.

Customers must follow operating, maintenance, snow-removal, and severe-weather instructions.


18. Intellectual Property

All website content, including text, photographs, videos, graphics, product names, logos, designs, drawings, renderings, and downloadable materials, is owned by or licensed to Pacific Horizon Living and is protected by applicable intellectual-property laws.

You may not reproduce, modify, distribute, publish, sell, scrape, reverse engineer, or commercially exploit our content without prior written permission.

Limited personal use of publicly available website content is permitted only for evaluating or purchasing our products.


19. Reviews, Images, and Customer Submissions

When you voluntarily submit reviews, photographs, videos, testimonials, suggestions, or other content, you confirm that:

  • You have the right to submit it;
  • It does not violate another person’s rights;
  • It is accurate to the best of your knowledge; and
  • It does not contain unlawful, harmful, or misleading material.

You grant Pacific Horizon Living a non-exclusive, worldwide, royalty-free license to use, reproduce, edit, and display the submitted content for business and marketing purposes, unless prohibited by law or otherwise agreed in writing.

We will not claim ownership of confidential project materials merely because they are sent for quotation or support.


20. Acceptable Use

You may not use the website:

  • For unlawful or fraudulent purposes;
  • To interfere with website security or operation;
  • To introduce viruses or malicious code;
  • To scrape or harvest data without authorization;
  • To impersonate another person;
  • To submit false payment or account information;
  • To infringe intellectual-property rights; or

We may suspend access where reasonably necessary to protect the website, customers, or business.


21. Third-Party Services and Links

Failure to make payment when due may result in suspension, cancellation, storage charges, collection activity, or withholding of shipment, subject to applicable law and the order agreement.


23. Taxes and International Charges

Applicable sales tax, value-added tax, goods and services tax, duties, and other government charges may be added where required.

For international transactions, unless expressly included in writing, customers are responsible for:

  • Import duties;
  • Customs taxes;
  • Brokerage;
  • Port charges;
  • Local inspection fees; and
  • Destination-country compliance costs.

24. Limitation of Liability

To the fullest extent permitted by applicable law, Pacific Horizon Living will not be liable for indirect, incidental, special, punitive, exemplary, or consequential losses, including:

  • Loss of use;
  • Lost profits;
  • Business interruption;
  • Project delay;
  • Third-party contractor charges;
  • Landscaping restoration;
  • Temporary accommodation;
  • Equipment rental; or
  • Missed installation appointments.

To the fullest extent permitted by law, our total liability relating to a product or order will not exceed the amount paid for the affected product or service.

These limitations do not apply where liability cannot legally be limited, including rights or remedies provided by mandatory consumer law.


25. Indemnification

To the extent permitted by law, you agree to indemnify Pacific Horizon Living against third-party claims arising from:

  • Your unlawful use of the website;
  • Your breach of these Terms;
  • Inaccurate site or measurement information;
  • Unauthorized product modification;
  • Installation contrary to instructions or codes; or
  • Your infringement of another party’s rights.

This section does not require consumers to indemnify us for our own negligence, misconduct, or legal responsibility.


26. Force Majeure

Pacific Horizon Living will not be responsible for delays or failures caused by events beyond our reasonable control, including:

  • Natural disasters;
  • Severe weather;
  • Fire or flood;
  • War or civil unrest;
  • Government restrictions;
  • Epidemics;
  • Port closures;
  • Transportation disruption;
  • Labor disputes;
  • Utility failures;
  • Material shortages; or
  • Supplier interruptions.

This section does not remove any refund, cancellation, or consumer right that applies under mandatory law.


27. Consumer Rights

These Terms do not exclude, restrict, or replace rights that cannot legally be waived.

Customers may have additional rights based on their province, state, territory, country, or place of residence.

For example, online sellers serving consumers in some markets must provide specified pre-contract information, and unfair consumer contract terms may not be enforceable.

Where these Terms conflict with mandatory consumer-protection law, the applicable law will control.


28. Governing Law and Disputes

31. Entire Agreement

These Terms, together with the applicable quotation, order confirmation, approved drawings, Privacy Policy, Shipping & Delivery Policy, Return, Cancellation & Refund Policy, and Limited Product Warranty, form the agreement between the customer and Pacific Horizon Living regarding the applicable transaction.

If documents conflict, the following order of priority should generally apply:

  1. Signed project or sales agreement;
  2. Final written order confirmation;
  3. Approved project drawings and specifications;
  4. Product-specific written terms;
  5. These Terms of Service;
  6. General website information.

32. Changes to These Terms

We may update these Terms periodically.

Changes will apply prospectively from the updated effective date unless applicable law requires otherwise. Changes will not retroactively alter confirmed orders without the customer’s agreement where such agreement is legally required.

The current version will be posted on this page with the revised date.
